Kentucky Criminal Record Expungement, Sealing, Pardons, and Restoration of Rights
Expunge your Kentucky Criminal Record
Living with a criminal record from Kentucky can be difficult, as the negative effects can follow you for a lifetime. Fortunately, Kentucky has recently expanded its laws for expungements to allow most misdemeanors and many other felony convictions to be eligible. Once a Kentucky offense is expunged, the records are deleted and it is as though the case never occurred. Furthermore, the matter shall not appear on official state-performed background checks, and the persons and court may legally state that the no record exists with respect to the person if asked.
Under Kentucky law, certain Class D felony convictions are now eligible to be vacated, dismissed, and ultimately expunged. The applicant must wait five (5) years after the completion of the person’s sentence, and must not have any pending charges, among other requirements. Class A, B, and C felonies are not eligible. Kentucky also allows an individual to petition for the expungement of any number of misdemeanor convictions. Sex offenses and offenses committed against a child are not eligible, and no other charges may be pending, among other requirements.
A person may also petition for the expungement of a record which was dismissed, and did not result in a conviction. Or, if you received felony charges which did not result in a grand jury indictment, you may petition to expunge those records as well. There must be no current charges or proceedings pending related to the matter, among other requirements. Finally, the expungement of juvenile records is available in many cases other than felony-level convictions. Upon sealing, only specified persons may inspect the record, and the juvenile may deny the existence of any record.
Having a criminal record expunged in Kentucky can provide numerous benefits. Among those may be the restoration of firearm rights to an individual; yet, the current legal interpretation is somewhat incomplete. Sorting out the various methods of expungement and legal requirements can be a difficult task.
